Terms and Conditions of Sale

It has been agreed as follows:
Preamble
The Seller specializes in the sale of jewelry products and services to consumers through its website (https://canini.fr).
The list and descriptions of the products and services offered by the Seller can be consulted on the aforementioned website.
Article 1: Purpose
These General Terms and Conditions of Sale (CGV) define the rights and obligations of the parties in the context of the online sale of products or services offered by the Seller.
Article 2: General Provisions
These CGV govern all sales of products or services made through the Seller's website and form an integral part of the contract between the Buyer and the Seller. They are fully enforceable against the Buyer, who accepts them before placing an order.
The Seller reserves the right to modify these CGV at any time by publishing a new version on its website. The applicable CGV are those in force at the time of payment (or the first payment in the case of multiple payments) for the order.
The Seller ensures that the Buyer's acceptance is clear and unreserved by implementing a checkbox and a validation click before the order is placed.
The Buyer declares that they have read and accepted these General Terms and Conditions of Sale, as well as any Specific Conditions related to a particular product or service, without restriction or reservation.
The Buyer also confirms that they have the legal capacity to enter into a contract under French law or that they are legally representing a natural or legal person for whom they are acting.
Unless proven otherwise, the data recorded by the Seller constitutes proof of all transactions.
Article 3: Prices
The prices of the products sold through the website are indicated in Euros, excluding taxes and are clearly specified on the product description pages.
They are also displayed in Euros, including all applicable taxes (VAT + other potential taxes) on the order summary page, excluding shipping fees.
The Seller reserves the right to modify its prices at any time while ensuring that the price applied to an order remains the one indicated at the time of purchase.
Article 4: Products and Services
The essential characteristics of the products and services, along with their respective prices, are made available to the Buyer on the Seller’s website.
In accordance with Article L112-1 of the French Consumer Code, the Buyer is informed, through appropriate means (marking, labeling, display, etc.), of the prices and specific conditions before any sale is finalized.
The total amount due by the Buyer is indicated on the order confirmation page, including product prices and additional shipping costs.
Article 5: Delivery Terms
Products are delivered to the shipping address provided by the Buyer during the order process, within the estimated delivery timeframe.
These delivery times do not include the order processing time.
Article 6: Payment
Payment is due immediately upon ordering, including for pre-ordered products.
Secure online payment by credit card is processed through our payment provider.
Once the payment is initiated by the Buyer, the transaction is immediately debited after verification of the provided details. In accordance with the French Monetary and Financial Code, payment authorization given via a credit card is irrevocable.
By providing their banking details, the Buyer authorizes the Seller to charge their card for the total amount due.
The Buyer confirms that they are the legal owner of the card and have the right to use it.
In case of payment error or failure to debit the card, the sale is automatically canceled, and the order is voided.
Article 7: Right of Withdrawal
In accordance with Article L 221-5 of the French Consumer Code, the Buyer has the right to withdraw from the purchase without providing any reason, within 14 days from the date of order receipt.
The right of withdrawal must be exercised by contacting the Seller via email at: contact@canini.fr.
If the right of withdrawal is exercised within the stated period, the price of the purchased products, as well as any initial shipping fees, will be refunded. Return shipping costs remain the responsibility of the Buyer.
For hygiene reasons, earrings cannot be returned or exchanged (unless the item is defective).
Article 8: Warranties
Under applicable law, the Seller provides the following warranties:
- Compliance warranty
- Warranty against hidden defects
If a product is defective or does not match the order, the Seller agrees to refund or exchange the product.
Refund requests must be sent via email to: contact@canini.fr.
Article 9: Complaints & Mediation
If necessary, the Buyer may submit a complaint by contacting the Seller via email at: contact@canini.fr.
Article 10: Force Majeure
The Seller's obligations under this contract may be suspended in the event of unforeseen circumstances or force majeure that prevents their execution.
The Seller will inform the Buyer as soon as possible in such a case.
Article 11: Protection of Personal Data
In compliance with Regulation 2016/679 (GDPR) of April 27, 2016, regarding the protection of personal data, the Seller collects and processes Buyer data for the purposes of selling and delivering the products and services defined in this contract.
